Court Appearance of Sabrina Kauldhar: Mental Health Defense in Murder Case

A woman accused of murdering three people over three days last fall appeared in court on Friday, with her lawyer arguing that she should be found unfit to stand trial due to her mental health issues.

Charges Against Kauldhar

Sabrina Kauldhar, 26, has been charged with first-degree murder in the deaths of a man and two women. The Crown alleges that she killed them between October 28 and October 31.

Defense Argument

Kauldhar’s lawyer, Michael Callaghan, told Justice Russell Silverstein that his client is not fit to stand trial because she suffers from schizophrenia and schizoaffective disorder.

Psychiatric Testimony

Forensic psychiatrist Dr. Amina Ali testified that Kauldhar was diagnosed with schizophrenia and schizoaffective disorder in February 2022 after being hospitalized at Credit Valley Hospital for treatment under a treatment order at the Centre for Addiction and Mental Health (CAMH).

  • Dr. Ali noted that Kauldhar was prescribed two anti-psychotic medications during her stay at CAMH but stopped taking them when she left the hospital against medical advice.
  • The doctor observed that Kauldhar’s behavior has changed significantly since she resumed treatment at CAMH’s forensic unit for mentally disordered offenders (FMDU). She now engages with staff members when she wants something, unlike before when she remained mute.

Incidents at FMDU

However, Dr. Ali also testified that during her stay at FMDU, Kauldhar assaulted a patient and a worker after becoming agitated about being confined to seclusion for 15 days without access to medication or therapy sessions.

  • Following an incident on November 8 last year, which occurred just one day after Kauldhar had been transferred back into seclusion, she expressed a desire to return to treatment, stating:
    • "I need help."
    • "Can you say I’m unfit? I can’t be at jail."
    • "I feel unsafe."

Justice’s Observations

Justice Silverstein noted that it appears Kauldhar is trying to be found unfit so that she can be taken out of jail and placed into a hospital instead. He remarked, "I think implicit in the doctor’s evidence is that Ms. Kauldhar is angling to be found unfit so as to be taken out of jail and put in hospital."
